France: New legislative proposal to regularize undocumented workers

The issue of regularizing undocumented workers is back on the French parliamentary agenda. On October 6, 2026, deputy Paul Christophle introduced bill No. 3253, which seeks to simplify the process of obtaining residence permits for foreign workers lacking legal status. The proposal suggests that anyone who can provide evidence of at least six months of employment within the last two years should automatically receive a "salaried" residence permit, bypassing the need for a long-stay visa. Targeting sectors like construction and hospitality, the plan could potentially affect 300,000 workers. This initiative differs from the January 26, 2024, legislation by removing the three-year residency requirement and the restriction to specific shortage occupations. Furthermore, the permit would be issued as a legal right upon meeting the criteria, moving away from the current system which relies on the discretion of local prefects.
