Criminal Code Amendments: Expansion of Capital Punishment

The most recent edition of the Official Gazette has published amendments to the Criminal Code, which include provisions for the death penalty for specific offenses. Under Article 291, individuals convicted of kidnapping a child coupled with torture, sexual assault, or physical abuse face the death penalty, with no eligibility for mitigating circumstances. Furthermore, Articles 395 bis and 396 bis mandate the death penalty for arson involving forests, agricultural land, or public and private property. This applies particularly when the acts are committed on behalf of foreign entities, by organized criminal groups, or if they jeopardize national security, the economy, or public order. The law also extends capital punishment to those who incite, finance, or facilitate such crimes through any means, including social media. Offenders convicted under these arson-related provisions are ineligible for reduced sentences, and the death penalty is mandatory if the arson results in loss of life.
