Challenging an OQTF: New Legal Deadlines in France

Following the immigration law reform of January 26, 2024, the procedures for challenging an Obligation to leave French territory (OQTF) have been revised. For decisions issued since July 15, 2024, the time frame to appeal to the administrative court is determined by the individual's current status rather than the type of OQTF. The standard period for filing an appeal is one month. This deadline is shortened to 7 days for individuals under house arrest or in prison, and to 48 hours for those in administrative detention. These rules apply to all foreign nationals, including Algerian citizens, who remain eligible to claim rights under the 1968 Franco-Algerian agreement. It is essential to consult the notification document for the specific deadline, as administrative appeals do not extend these periods. Appeals can be submitted online or via the court registry, and they legally suspend the removal process until a judicial decision is reached.
