New legislative proposal seeks to lift territorial restrictions on residence permits in Mayotte
A proposed law is reigniting discussions regarding residence permits in Mayotte, specifically targeting the rule that limits the validity of these permits to the island itself. Introduced in March 2025 by Senator Saïd Omar Oili, the bill failed to pass the Senate's Law Commission and is scheduled for a plenary session debate on November 4, 2026. The current regulation, Article L. 441-8, restricts certain foreigners' residency to Mayotte, with limited exceptions. While a law enacted in August 2025 already mandates the removal of this restriction by January 1, 2030, the new proposal aims to bring this deadline forward. Legal experts note that this change would not confer new rights to undocumented migrants and raises questions regarding the status of existing permits due to a lack of transitional measures. For now, the legal status quo remains in place, and current rules regarding travel outside the territory still apply.
