French Court Overturns Deportation Order After Identity Mix-up
A Marseille administrative court has overturned a prefectural order that denied a residence permit to an Algerian national and issued a deportation notice (OQTF). The January 2026 decision by the Bouches-du-Rhône prefecture was initially justified by criminal records posing a threat to public order. However, the court discovered that the records belonged to another person with the same name. Additionally, the court ruled that the applicant was entitled to a "private and family life" residence permit under the 1968 Franco-Algerian agreement, as he is the father of a French child. Consequently, the authorities must issue him a one-year residence permit within two months and pay 1,500 euros in legal costs.
